If an officer is read Miranda
and he or she
invokes one or more of the Miranda Rights, the agency can request that the
Prosecutor's Office or AG's Office grant "use
immunity." If use immunity is granted, the agency can require
the officer to provide a statement, but the statement may not be used in a
criminal prosecution. It may only be used against the officer for
departmental charges. When this occurs, the "Garrity
Statement" is first read to the officer.

Internal Affairs, or IAB for
Internal Affairs Bureau, is a unit within law enforcement agencies that
investigates accusations of police officer misconduct. Most of these
allegations are found to be unfounded as it is common for arrested person to
make internal affairs complaints against arresting officers with the hope of
using it as a bargaining chip later in court. In recent years, Internal
Affairs has moved away from just misconduct complaints. Many agencies use
the IA unit to handle officer commendations as well in addition to certain
training.
